Determining whether to go through mediation or not

Once the decision to get a divorce has been made, estranged Virginia couples will need to determine how they want to go about actually ending their marriage. If the couple is able to work together, mediation may be an appropriate method. However, it should be noted that it will not work for everyone.

First, mediation can be a very slow process, meaning it will not work for those who are interested in finalizing their divorce as soon as possible. Mediation often requires the parties to negotiate and re-negotiate over a long period of time. In the meantime, the former couple will be expected to co-parent as they intend to once the divorce is finalized.

Those who cannot advocate for themselves or who were involved in a violent or abusive marriage may also not be eligible to go through the mediation process. If people cannot advocate for themselves, there is a possibility that an agreement that they are not happy with will be made. This can lead to resentment later on. When it comes to abuse or violence, a person may not seek all that he or she is entitled to out of fear.

If a couple wants to get their divorce finalized as quickly as possible so that they can move on with their lives, they may want to skip mediation. However, there are other options available that can still allow individuals to protect themselves while ending the marriage quickly. For example, a family law attorney may take a client’s wishes and goals into account when attempting to negotiate a comprehensive settlement agreement.
